Rule 9036 of the Federal Rules of Bankruptcy Procedure (Notice by Electronic Transmission) provides that:
As required by Rule 9036, F.R.Bankr.P., a noticing agreement must be signed by the notice recipient. The noticing agreement defines the terms and conditions for electronic noticing. With EBN Phase I, the Clerk's Office, for the Court, monitors (and the Clerk signs) each agreement before routing it to the Bankruptcy Noticing Center (BNC) for implementation. With EBN Phase II, the Court has elected to authorize the BNC to administer directly the notice agreement process. Notice recipients will sign up directly with the BNC for EBN Phase II services (using either the Internet E-Mail method - with PDF file attachment or the FAX transmittal method). If a notice recipient elects the EBN Phase II Internet E-Mail method, Rule 9036, F.R.Bankr.P., requires that the notice recipient only use those Internet Service Provider (ISP) E-Mail services that provide a Delivery Service (DSN) back to the BNC. Use of the BNC's EBN Phase I and Phase II services by notice recipients is entirely voluntary. To sign up for any of the Electronic Bankruptcy Noticing services: |
