Recent Changes

Amendments to Federal Rules of Practice and Procedure
Effective: December 1, 2011

Congress has taken no action on the amendments to the Federal Rules of Appellate, Bankruptcy, and Criminal Procedure, and the Federal Rules of Evidence, approved by the U.S. Supreme Court on April 26, 2011. Under the Rules Enabling Act, 28 U.S.C. § 2072, the following amendments to the rules take effect on December 1, 2011:

Appellate Rules 4 and 40;
Bankruptcy Rules 2003, 2019, 4004, and 6003, and new Rules 1004.2 and 3002,1;
Criminal Rules 1, 2, 4, 6, 9, 32, 40, 41, 43, and 49, and new Rule 4.1; and
Restyled Evidence Rules 101-1103.

Under 28 U.S.C. § 2074(a) and the April 26, 2011, Supreme Court orders, the amendments will govern all proceedings commenced on or after December 1, 2011, and all proceedings then pending "insofar as just and practicable."


CM/ECF Releases 4.0, 4.1 & 4.2 Compliant
Effective: November 21, 2011

  1. Access to CM/ECF, PACER/Net, BOPS, VAEB Calendar, CHAP and VCIS

    Access to CM/ECF, PACERNet, BOPS, VAEB Calendar, CHAP and VCIS will not be available commencing at 4:30 P.M., Friday, November 18, 2011. Access is expected to be restored at or about 8:30 A.M., Monday, November 21, 2011. The Court’s Bankruptcy CM/ECF System will be upgraded from Bankruptcy CM/ECF 3.4 through Releases 4.0 and 4.1 to 4.2. Periodically check for restored access.

  2. CM/ECF Electronic Learning Modules and other On-Line Training Materials

    This upgrade includes a number of new features and functional enhancements. To assist external users in preparing for the upgrade, the CM/ECF Users’ Guides page has been updated. Click here to access the Electronic Learning Modules and other on-line materials. Information also is available on the Attorney Online Manual page.     The CM/ECF Users’ Guides page includes links to Release Notes for PACER Users – 4.0, 4.1 and 4.2 (for ease of reference, information set forth in the Release 4.0 Notes for PACER Users document has been incorporated into the Release 4.1 Notes document). In addition, a Summary of New Features for External Users document and Summary of New Features for Chapter 7 and 13 Trustees document have been prepared by the Court.

    The Training Branch of the IT Systems Deployment and Support Division of the Administrative Office of the U.S. Courts has created Electronic Learning Modules (ELMs). The ELMs are located on the CM/ECF Users’ Guides page. They are intended to acquaint users with some of the enhancements that will be available with the new releases. The ELMs, however, are not intended to cover every possible activity and are subject to customization. Each ELM is a short lesson covering a specific CM/ECF topic and is designed to be taken at the user’s own pace. The ELMs address: Adversary Proceeding Opening; Proof of Claim Form B10; Trustee 341 Meeting Filings Chapter 7; and Trustee 341 Meeting Filings Chapter 13. Workstation system requirements are listed as well.

    PDF training materials are available on the CM/ECF Users’ Guides page. They consist of: Adversary Case Opening, Case Report; Claims Filing; County Codes; Docket Report; Noticing; Password Security; Query; and Trustee 341 Filings. Read the password security requirements with particular care.

  3. Bankruptcy CM/ECF Release 4.2

    Bankruptcy CM/ECF Release 4.2 principally addresses new Federal Rule of Bankruptcy Procedure 3002.1, due to take effect December 1, 2011, absent action taken to the contrary by Congress, which is not anticipated. This new rule addresses certain claims in chapter 13 cases.
