Notice: Norfolk and Newport News Divisions’ Procedures on Entry of Default and Default Judgment-Effective March 1, 2018

Effective immediately in the Norfolk and Newport News Divisions, a plaintiff seeking entry of a default judgment pursuant to Federal Rule of Civil Procedure 55, as incorporated into the Federal Rules of Bankruptcy Procedure by Rule 7055, must file a Motion for Entry of Default with the Clerk of this Court in compliance with Local Bankruptcy Rule 7055-1. After securing entry of default, the plaintiff may then file a Motion for Default Judgment, which shall also comply with Local Bankruptcy Rule 7055-1. The Court will issue an order denying a Motion for Default Judgment filed prior to the entry of default.
