PROCEDURE FOR ZOOM HEARINGS
Continuing until further notice, unless otherwise ordered, all proceedings before Judge Klinette Kindred will be conducted by video conference via Zoom for Government.Parties wishing to participate in hearings via Zoom for Government must transmit, via e-mail, a completed PDF-fillable request form, found at https://www.vaeb.uscourts.gov/wordpress/?wpfb_dl=871 to EDVABK-ZOOM-Judge_Kindred@vaeb.uscourts.gov.This email address shall be used only to submit Zoom Requests. No other matters or requests will be considered by Chambers staff and under no circumstances will any such matters or requests be brought to the Judge’s attention. Failure to comply with these instructions may result in appropriate action, including but not limited to the imposition of sanctions.Absent compelling circumstances, the request form must be submitted no later than two (2) business days priorto the hearing or proceeding. Judge Kindred’s chambers will then provide the requesting party with a ZoomGov registration link.All participants must separately register for the video conference no later than one (1) business day priorto the hearing or proceeding. Persons that register will receive separate email notification on whether their registration has been approved or denied. In the event that registration is approved, the confirmation email will include the participant’s unique link to the video conference.Any evidence the parties which to present at the hearing must be uploaded to the case’s CM-ECF docket 48 hours in advance if the exhibit is not already on the docket. Exhibits must be uploaded in PDF format and must be filed as Exhibits/Attachments to an Exhibit List in sequential order, Plaintiff numerically and Defendant alphabetically. All pages of each exhibit should be marked with a page number in the lower right-hand corner.A list of any witnesses the parties wish to call to give evidence must be filed 48 hours in advance and each witness must be registered to appear.Anyone testifying or providing evidence must appear by video.They cannot block their video and just use audio on their computer or call in on their phone without video.Under no circumstances may any participant or listener record or broadcast the proceedings.

HEARING CANCELLATIONS
Pursuant to Local Bankruptcy Rule 9013-1(O), the moving party is responsible for notifying the Court of any settlement or other valid reason that a hearing or trial need not be conducted.

HEARING CONTINUANCES
For matters that are set for an evidentiary hearing, whether in an adversary proceeding or a contested matter, any party requesting a continuance must file a written motion stating grounds for the requested continuance. The Court will permit continuance requests to be made by telephone for motions to be heard on a regularly scheduled Motions Day. The moving party should contact the Judge’s Chambers to request a continuance.

LENGTH OF HEARINGS
Counsel are encouraged to consult with each other concerning the anticipated length of hearings. Regularly scheduled Motions Days may be used as scheduling conferences. Counsel should advise Chambers in advance of the hearing that they will be seeking to have the matter specially set.

EXPEDITED HEARINGS
The moving party should contact the Judge’s Chambers immediately upon the filing of a motion requesting an expedited hearing to ensure timely consideration.
