The Bankruptcy Noticing Center (BNC) has advised courts that it has resumed operations, following the recent service disruption. BAE Systems (BAE), which operates the BNC, has provided a schedule for resuming operations and processing the backlog of notices and certificates of notice. Processing will occur in phases, in parallel with newly received court submissions, until normal operating conditions are restored.
BAE has indicated that electronic notices will be transmitted as quickly as possible following validation. Paper notices will be staged separately and released in prioritized waves based on available production capacity and mailing readiness.
Important Information About Delayed Notices
Due to the service disruption, some paper notices may be received later than intended. As a result, a deadline or response period stated in a notice may have passed by the time the notice is received. To help address this issue, BAE will include the following message on the address page of all paper notices generated from October 13, 2026, through the present:
IMPORTANT NOTICE: The enclosed notice(s) may have been sent later than intended because of a service disruption affecting the Bankruptcy Noticing Center. The information in this notice is still valid, but because of the delay, a deadline or response period listed here may have passed and you may receive an amended notice. Should you have questions regarding a deadline or a response period, please contact your attorney or visit the website of the clerk’s office of the court named on this notice.
The courts are also working with BAE to provide additional information on BAE’s websites regarding delayed notices.
Questions Regarding Privacy or the Cybersecurity Incident
Individuals with specific questions regarding BNC notice privacy concerns or the cybersecurity incident may contact BAE directly at ebn@baesystems.us .
Bankruptcy Rules Emergency Declaration Remains in Effect
On October 23, 2026, the Executive Committee of the Judicial Conference, acting on behalf of the Judicial Conference, declared a “Bankruptcy Rules emergency” under Federal Rule of Bankruptcy Procedure 9038. Although BNC services are expected to resume, the emergency declaration remains necessary to support the full restoration of services and help ensure that parties are not prejudiced by the disruption.
Additional updates will be provided as information becomes available.
