Entry of Norfolk and Newport News Standing Order 23-2 – Confirmation Hearings in Chapter 13 Cases

Pursuant to the referenced Norfolk and Newport News Standing Order 23-2, entered on March 17, 2023, by Bankruptcy Judge Stephen C. St. John and Chief Bankruptcy Judge Frank J. Santoro, for the Norfolk and Newport News divisions of the Court, it is ORDERED that:

  1. Effective June 1, 2023, Norfolk and Newport News Standing Order 18-1, entered on October 9, 2018, is VACATED. That Order provided that Confirmation Hearings would be held in Chapter 13 original and amended plans, which were filed on or after October 29, 2019, in the Norfolk and Newport News divisions of the Court without regard to whether objections were filed to the plan.
  1. For Confirmation Hearings on original or amended Chapter 13 plans scheduled on or after June 1, 2023, such hearings shall be held only if an objection to confirmation is filed timely and either is not resolved or for which an amended plan is not filed prior to the scheduled Confirmation Hearing. Counsel and parties should refer to the Undersigned Judges’ Procedures for Hearings pages on the Court’s website (www.vaeb.uscourts.gov) for hearing dates and times and for information regarding canceling hearings.
